Party Wall Act
The Party Wall Act 1996 brought the rest of the UK in line with the procedures already in place in London.
Basically, since 1997 if you’ve wanted to build on or extend or alter your property, and that work involves altering, cutting into, raising, digging alongside etc a wall, boundary wall, floor (or similar) that joins you to another property – this can even be a garden wall – then it is quite likely that you must have to go through the process(es) prescribed by the Party Wall Act.
The reasoning behind the Party Wall Act was to help avoid expensive legal disputes between neighbours over such matters, and there is a widely held view that this has been a successful piece of legislation. Some kinds of work like simple maintenance – for example redecorating – do not come under The Party Wall Act.
If proposed work comes under that outlined in The Party Wall Act, then agreement must be obtained before the work starts.
Party Wall surveyors should have specialist knowledge of and offer the service of taking you through the Party Wall Act process, whilst acting impartially.
